Recently, the "Detailed Rules for the Administration of Tobacco Monopoly Licenses for Electronic Cigarette Related Production and Wholesale Enterprises (Draft for Comments)" were released, which has attracted high attention from the industry regarding the important changes in "renewal of licenses for export-oriented electronic cigarette products".

In the past, exporting electronic cigarette products usually only required meeting the regulatory standards of the destination country or region. According to the latest draft for soliciting opinions, the renewal application or on-site verification process will require exported products to be tested in accordance with some provisions of the national standard GB 41700, which means:

Export ≠ exemption from national standard testing, and critical safety testing will become the "hard threshold" for license renewal.

The four key testing items explicitly required in the draft opinion (applicable to exported electronic cigarette products) include:

1. Drop strength test

2. Leak proof liquid test

3. Detection of impurities and pollutants in atomized materials

4. Detection of carbonyl compound release in the released material

Enterprises are required to provide corresponding inspection reports or market access certificates from the destination country for export. If qualification certificates or past supervision and spot check records cannot be provided, additional testing will be required during the on-site verification stage of certificate renewal.

How should companies prepare?

For enterprises that are about to renew their licenses or are exporting electronic cigarette products, it is recommended to:

Prepare a testing report that complies with GB 41700 in advance to complete the above testing items;

• Prepare market access documents for the export destination country;

Pay attention to the final implementation of policies and prepare for compliance.
